1.Registration instructions 

1.1

5181.com agrees to provide services based on the internet and related to its products in accordance with this Agreement and the operation procedures released from time to time (“the Services”).  The service user (“the User”) shall, in order to acquire the Services, accept all terms and conditions herein and finish the registration procedure according to the prompts on the page.  The User is deemed to accept all terms hereunder by clicking “Agree” in the process of registration.  

1.2

The User shall be fully responsible for the security of the user name and password when he successfully finishes registration procedure.The User may change his password from time to time, but shall not transfer his account number or password or lend it to other people. If the User finds out that his account number is used by other people illegally or has loopholes in security, he shall immediately inform the customer service clerk of 5181.com.  5181.com assumes no liability for illegal use of the account number or password as a result of hacking or the User’s negligence in safekeeping them.  

2.Service contents and requirements 

2.1

5181.com will provide the internet service according to its actual condition, including but not limited to information surfing, searching, etc. 

2.2

To obtain the above services, the User shall 

 (1)Have necessary equipment for accessing the internet, including personal computer, mobile phone, iPad, modem or other devices. 

(2)Bear relevant telephone or internet access fees in relation to the services. 

2.3

In view of the importance of the Services provided by the website, the User shall agree to: 

(1)Provide detailed and accurate personal data;

(2)Update registration data from time to time to make it up-to-date, thorough and accurate;

(3)Once the User registers in 5181.com, the website will provide information and service on its products by way of email/SMS/QQ /Skype/Facebook/WeChat and etc. from time to time, and the User agrees to accept such information and not to treat it as junk  mail or junk message. 

2.4

5181.com may disclose the name, address or email address of the User, including sending his CV to the client. 

3.Change, suspension or termination of service 

3.1

Due to the special nature of the internet service, the User agrees that 5181.com has the right to change, suspend or terminate all or part of the internet service at any time (including the paid internet service).  If the free internet service is to be changed, suspended or terminated, 5181.com does not need to inform the User, nor does it need to give a prior notice to the User. If the paid internet service is to be changed, suspended or terminated (including the product service), 5181.com shall give a prior notice to the User, and provide the User with the alternative paid internet service of the equivalent value. Should the User be unwilling to accept such service, in respect of the services fee already paid, 5181.com shall deduct the fees for the service already used and refund the remaining part to the User.  For the activity released by 5181.com on its website, the User shall register for it by providing the true personal information, and 5181.com reserves the right to interpret and change the activity and its rules.  

3.2

5181.com has the right to change the service terms as necessary, which will be announced in the webpage. The User may stop using the service if not accepting the changes, and if he continues to use the service, the act will be deemed an acceptance of the change.  5181.com keeps the right to change or suspend the free service without prior notice to the User. 5181.com bears no liability to the User or the third party in exercising its right to change or suspend the free service.  

3.3

In one of the following circumstances, 5181.com has the right to suspend or terminate the service hereunder (including the paid product service) without assuming any liability to the User or any third party:

3.3.1 The User provides false personal information;

3.3.2 The User violates use rules specified in the Agreement;

3.3.3 The User fails to pay the service fee to 5181.com as agreed when using the paid service (product service). 

4.Restriction of the rights

4.1

The User enjoys the copyright and other lawful rights over the contents crated by him and uploaded to the website via service of 5181.com (including but not limited to blog, forum, etc).  For any content uploaded by the User to the publically accessible area via service of 5181.com, the User agrees that 5181.com enjoys the free, permanent and irrevocable right and permit worldwide to use, duplicate, change, translate, create derivative works, disseminate, perform and display such content (in whole or in part). 

4.2

The User must abide by the following principles in the course of using the service of 5181.com:

4.2.1 Observe applicable laws and regulations;

4.2.2 Observe all internet agreements, rules and procedures in respect of the internet service;

4.2.3 Don’t use the internet service system for any illegal purpose;

4.2.4 Don’t use the service of 5181.com in any form to infringe the business interests of the website, including without limitation  release of commercial ads not authorized by the website;

4.2.5 Don’t use the service system of 5181.com to engage in any activity that may impair normal operation of the internet;

4.2.6  Don’t use the service of 5181.com to upload, exhibit or spread any information that is false, provocative, slanderous, abusive , minatory, vulgar, indecent or otherwise illegal;

4.2.7 Don’t infringe upon the right of patent, copyright, trade mark, reputation or any other lawful interests of any third party;

4.2.8 Don’t use the service system of 5181.com to engage in any activity detrimental to the website;

4.2.9Immediately inform 5181.com if he finds any illegal use or loopholes of the account number.

4.3

If the User violates any of the above regulations in his use of the service, 5181.com or the person authorized by it has the right to demand the User to rectify his behavior or directly adopt any measures necessary (including without limitation change or deletion of the content posted, suspension or termination of the User’s right to use the service) to lessen the negative impact of such behavior.  In the case of infringing the right of the third party, the User concerned shall be held for liability and will be subjected to criminal liability in the case of committing a crime.  Meanwhile, 5181.com reserves the right to claim compensation. 

4.4

Any statement, notice or warning in any form made in respect of the specific network service (including without limitation webpage announcement, email, short message, etc) shall be deemed to be a part of this agreement, and use of such service of 5181.com shall be deemed consent of such statement, notice or warning. 

5.IP right 

5.1

Any text, picture, image, audio and/or visual data contained in the service of 5181.com is subject to protection of laws on copyright, trade mark and/or other property rights, and without consent of the right owner, such data may not be released, played, adapted or re-distributed for the purpose of play or release in a direct or indirect way, or for any other commercial purpose.  Those data or any part of them can only be stored in a computer for personal instead of commercial use.  5181.com will not be liable for any compensation arising out of or in connection with the delay, inaccuracy, mistake or omission in the course of generating such data or delivering or transferring all or part of such data, nor will it be liable to any user or the third party. 

5.2

For the software service to be provided by 5181.com, its copyright belongs to 5181.com, and without permit, the Use may not take such act as reverse engineering, decompiling or disassembling against the software. 

6.Disclaimer

Execution of this Service Agreement means that the User agrees to bear the risk in relation to the use of the service of 5181.com, and 5181.com bears no liability to the User.  In respect of the network service, 5181.com will do its utmost to ensure its timeliness, security and accuracy, but will not make any commitment.  For service suspension or other defects resulting from the force majeure events or reason beyond control of 5181.com, 5181.com will not assume any liability, but will try its best to lessen loss or impact to be sustained by the User. 

7.Liability for breaching of the Agreement

The User agrees to safeguard and protect the interests of 5181.com and other users, if in violation of the law, regulation or any provisions hereunder, thus causing loss to 5181.com or any third party, the User agrees to undertake the liability for compensation. 

8.Delivery of notice 

8.1

All notices to be given hereunder to the user of 5181.com may be made in the form of webpage announcement, email, mobile short text message or regular mail, which shall be deemed to reach the recipient on the same date when they are given. 

8.2

The notice given by the User to 5181.com shall be delivered via the contact address, fax number or email address officially announced by 5181.com.  

9.Settlement of disputes and governing law

9.1

Conclusion, performance and interpretation of this Agreement shall be governed by the law of the PR. China and subject to jurisdiction of the court in China. 

9.2

Any dispute in respect of the content of the Agreement or its performance shall be settled first through amicable consultation between the two parties, and, failing which, either party may take it to the court in the place where 5181.com is located. 

10.Miscellaneous 

10.1

This Agreement constitutes the entire agreement between the two parties in respect of the subject matter and relevant matters contemplated herein, and no right is granted to any party other than those agreed herein. 

10.2

If any provision herein is invalid or unenforceable in part or in whole for reason whatsoever, the remaining provisions shall still be valid and binding. 

10.3 

The title of the Agreement is for the sake of convenience, and shall be disregarded in interpretation of this Agreement.
